The short version
We do not sell your information. Not your email, not your questionnaire answers, not your business data.
The free report costs an email address. You give us an email, we send you the report, and you go on our marketing list. Unsubscribe link in every email, works every time. That’s the whole trade and we’re not going to pretend it’s something else.
The questionnaire is where the real data lives. Revenue, customers, what’s not working, what you’ve tried. It’s confidential, it’s used to build your audit, and it doesn’t go anywhere else.
We research your business. Your site, your rankings, your reviews, your social, your competitors. Public sources and licensed research tools. Section 4 lists them by name. We don’t break into anything and we don’t buy data about individuals.
Your audit is delivered behind a password. One set of credentials per client. Don’t post the link.
Tracking. GA4, Google Ads, Meta, Microsoft Clarity. Clarity records mouse movement and clicks so we can see where the site confuses people. Opt-outs in Section 7.
Your rights. Access, correct, delete, port, opt out, appeal. Email us.

1. Who we are
1.1 TX Brand Audit is a division and assumed name of Gabe Rene LLC, a Texas limited liability company based in Kerrville, Texas. Gabe Rene LLC is the controller of the personal information described here. Audit services are performed by our GR Studio & Co. division.
1.2 This Policy covers txbrandaudit.com, audits.txbrandaudit.com, related subdomains, our forms and questionnaires, and information we handle in the course of performing brand audits.
1.3 The general Gabe Rene LLC Privacy Policy at gaberene.com/privacy also applies. Where the two conflict on a TX Brand Audit matter, this Policy controls.

Confidential business information. Questionnaires and workbooks routinely capture revenue, margins, customer counts, close rates, ad spend, and candid assessments of what is broken. This is confidential under our Terms of Service Section 9.3 and under any NDA between us. It exists to build your audit and it is used for nothing else.
3. Information collected automatically
3.1 IP address, browser and device type, operating system, screen size, language, referring URL, pages viewed, time on page, scroll depth, clicks, navigation paths, and access times, via cookies, pixels, tags, local storage, and server logs, deployed through Google Tag Manager (GTM-5L4LMC77).
3.2 Microsoft Clarity provides anonymized session replays and heatmaps recording mouse movement, clicks, taps, and scrolling. It masks text input by default.
3.3 Google Analytics 4, Google Ads, and Meta (including server-side Conversions API events)
collect advertising and conversion data, including a generate_lead conversion event when you
submit a form.
3.4 Audit portal access logs. We log access to audits.txbrandaudit.com, including timestamps and IP address, for security and to confirm delivery.
4. Research we perform
4.1 An audit is research. To build yours we collect information about your business, your competitors, and your market from:

4.2 What we do not do. We do not access private accounts without permission, circumvent authentication or paywalls, scrape data in violation of a platform’s terms, or purchase personal data about individuals.
4.3 Competitor research is limited to publicly available business information about those companies. It is not personal information about individuals, except where a named individual is a public-facing business figure whose role is public. If you are a competitor named in a client’s audit and you have a concern, contact us at gabe@gaberene.com.
4.4 Account access is temporary and minimal. Where you grant access to your analytics or advertising accounts, we access only what the audit requires, for as long as it requires. Revoke it whenever you want. We will also prompt you to remove it at close-out.
5. How we use information
To deliver Free Resources; to send marketing to people who requested them or opted in; to respond to inquiries and prepare proposals; to enter into and perform audit engagements; to research, analyze, build, and deliver audits; to host and secure your audit portal; to invoice and keep financial records; to communicate about an active engagement; to operate, secure, and improve the Site; to measure our own advertising; to develop anonymized case studies and benchmarks subject to Section 9.4; to protect our rights and prevent fraud; and to comply with law.
6. Free resources and marketing email
6.1 Requesting a Free Resource subscribes you to our marketing email. We state that on the form and we are stating it here.
6.2 Every marketing email includes a working unsubscribe link. Unsubscribing is immediate and permanent, and we keep a suppression record so we do not email you again by mistake.
6.3 Unsubscribing from marketing does not stop transactional email about an active audit engagement.
6.4 We comply with the CAN-SPAM Act.
6.5 We do not sell, rent, or share our email list with anyone.

Global Privacy Control. We honor the GPC signal as a valid opt-out of targeted advertising and sharing where applicable law requires. We do not currently respond to “Do Not Track,” as there is no consistent standard. Where required, we operate Google Consent Mode v2.
8. How we share information
8.1 We do not sell personal information and have not in the preceding twelve months.

8.3 We do not send your confidential questionnaire responses to third-party research tools. Those tools receive your public domain and identifiers so they can return public data. Your revenue figures and internal commentary stay with us.
8.4 Targeted advertising. We run Google and Meta ads. Under Texas and California law that may count as “targeted advertising,” or as “sharing” for cross-context behavioral advertising under the CCPA, even though no money changes hands. You may opt out. See Sections 7 and 9.
9. Confidentiality, portals, and case studies
9.1 Audits are delivered through a password-protected portal at audits.txbrandaudit.com, with per-client credentials enforced at the edge.
9.2 Keep your link and password inside your organization. Sharing them exposes your own business data.
9.3 We hold your business information in confidence, use it only to perform your audit, and disclose it only to personnel and contractors bound by confidentiality who need it. We will sign your NDA.
9.4 Case studies and benchmarks. We may develop anonymized benchmarks and aggregate insights from audit work across clients. Anything we publish is either anonymized so you are not identifiable, or approved by you in writing first. We do not publish your confidential figures. If you want your engagement kept entirely out of our marketing, say so and we will honor it at no cost.
10. Your privacy rights
10.1 We extend these rights to anyone who asks, regardless of residency:

10.2 How. Email gabe@gaberene.com with the subject “Privacy Request,” or write to the address in Section 16.
10.3 Timing. Forty-five (45) days, extendable once by another forty-five (45) with notice. EU and UK: one (1) month, extendable by two (2) months for complex requests.
10.4 Limits on deletion. We may decline where we must keep information to complete a transaction, comply with law, exercise or defend legal claims, maintain tax and financial records, or preserve proof of rights or scope under a contract. Deleting your account data does not obligate us to destroy a delivered audit, which is a work in which we hold copyright and which is already in your possession. We will explain the specific reason.
10.5 Free once per twelve-month period. We may charge for or decline manifestly unfounded, excessive, or repetitive requests, with an explanation.
11. Appeals
11.1 If we decline your request, email gabe@gaberene.com with the subject “Privacy Appeal,” including your original request and why you disagree.
11.2 We respond in writing within sixty (60) days with our reasons.
11.3 If we deny the appeal, you may complain to the Texas Attorney General at texasattorneygeneral.gov/consumer-protection, or to the authority in your jurisdiction.

13. Security
13.1 We use reasonable safeguards: encrypted transmission (HTTPS/TLS), access controls and strong authentication on business accounts, per-client password gating on audit portals enforced by a Netlify edge function, encrypted backups, and need-to-know access limits for contractors.
13.2 No system is completely secure and we cannot guarantee absolute security.
13.3 We will notify affected parties and authorities of a breach as required by law, including Texas Business and Commerce Code § 521.053.
14. Children
The Site is a business-to-business site intended for users 18 and older. We do not knowingly collect personal information from children under 13.
15. International transfers
We are in the United States and process information here. If you are outside the United States, your information is transferred to and processed here. Where we transfer personal data out of the EEA or UK, we rely on Standard Contractual Clauses, the UK International Data Transfer Addendum, or an Article 49 derogation.
16. Third-party links, changes, and contact
16.1 The Site links to third-party services. We are not responsible for their privacy practices.
16.2 We may update this Policy. We will change the “Last updated” date and give additional notice for material changes.
